its not if they are avoiding the tax....they're just using assets to pay for the payment of the tax, and thereby passing the wealth - 40000 per year to the trust/family/kids..... you can also see it this way....
a family with less than $2,000,000 gross estate....need not worry about estate tax, thereby not needing to "spend" $40,000 per year....and $2,000,000 dollar estate, for the avg. joe is nothing to scoff at.
in 2009 it increases to $3,500,000......
