If they put HR tires with a rating of 129 MPH(?) on his car then yes you would have a strong case.
From past expirences with manufacture's and tires, as long as the tires on the car fall within the specs of the capabilities...you don't have a case.

We are back to the little old lady response. If you would have properly understood his post, he received the cheaper Conti Touring not the Conti Sport or P zeros. The tires originaly supplied are both costlier and better handling. However, you are correct, if he wants to drive like a little old lady and Jaguar's term "Sport" is just a scam, he should not complain. With the internet, Jaguar could easily post any changes to specifications. The fraud with intent takes place when they intentionaly notify no one of the changes that devalue the car. Try to understand this, the difference in price between the 2.5 and the 3.0 is about $7000 for a posted acceleration of 6.6 seconds. This is the only difference your $7000 gets you. If they don't deliver the claimed difference do you understand how this is fraudulently charging $7000 for something they didn't deliver?
Jaguar's response was correct and NOT out of line. Car manufactures contract with tire companis for many differnt supplies of tires. MB, BMW, Lexus, and Acura have changes tires based on availabilty of the supply. At the time you car was built, the P Zero's might not have been available so the factory went with the alternate tire. The sale literature says that substituions might be made without notice. Another reason is that the P Zero's are wareing out too fast for some customers or customers that encounter rain or snow are not happy so Jaguar made a change.
As unhappy as you are, you have no leagal footing.
Since you will more than likely get 15 to 20K out of them, put P Zero's on next.
It isn't like your X is a M3 or a S4...you wont be or should be Auto crossing with it.

First off, I really enjoy this board and appreciate all the posts. In February, I leased a silver 3.0 sport, 5spd, x1, x3, and truly love the car. The performance is great in th city and on the highway. Although the last autoweek road test report seems to verify the acceleration figures, there is another area where I'm very disappointed with Jag. As indicated in the original R&T test report, the brochure, and the website, the tires included with the sport package were 225 45 zr 17 Pirelli P-Zeros or Continental Conti-Sport. My car has 225 45 hr 17 Continental Conti-Touring--not a bad tire, but hardly a true sport tire. I called Jag and complained to them about the apparent deception and their official response was "specifications can change at any time" and that is the correct tire. This is a bush league response. Does anyone with a sport package actually have the perormance tires or was this a bait and switch? Please comment...
