...be sure to get his insurance company to pay for diminished value after all is said and done with your car. They likely won't write a check for "diminished value" per se, but you should be able to get them to pay roughly 25-30% of the total repair cost to the vehicle on top of the repair cost as a "settlement". This is on top of your medical/lost wages payments of course.

Once the car is repaired to your satisfaction, start talking to them about diminished value. If it were your insurance company paying, you wouldn't have any luck. However, Texas law in some cases allows third-party claimants (that's you in this case) to obtain compensation for diminished value due to the fact your car will never be worth as much to a potential buyer as one physically identical to it that has never been in a wreck.
