It's only "your" car if your contract has a VIN number on it. If you do not have a contract with a VIN number on it, you have nothing that is legally enforceable. I went through this with a Mitsubishi 3000GT, dealer wanted to sell it to someone else over sticker when it came in, my contract had a VIN number since it was on the dealers inbound allocation when I signed the contract and left the deposit. My lawyer called them, told them that if the car with that VIN was sold to someone else, we would sue them for breach of contract. I got the car.
Can a dealer refuse to sell/give you the car you ordered and put a downpayment on? Would that be legal? It seems to me that all the legal elements of a "contract" exist (offer, acceptance and consideration) when you make an actual downpayment on a car. What say you?
