Message: 40hp without even opening the engine? If it were that easy then why did BMW waste time designing new engines instead of just changing their intake and exhaust?

IIRC, the real story with the Dinan stuff was that someone thought they could add together the advertised HP gain for each product and end up with a gain of 40hp at peak power. But this is not correct, because if product A gives you 12hp at 6050RPM and product B gives you 8hp at 3000RPM that doesn't tell you anything about what you're going to get by installing both.
